This Privacy Policy applies to all users of the Grow Learning Website, related mobile sites, social accounts, and software applications, collectively referred to as “The / Our Platforms”, which are used to access and purchase our products and services.

The purpose of this Privacy Policy is to set out how, why, and when Grow Learning Pty Ltd  uses your Personal Information to comply with the Protection of Personal Information Act 4 of 2013 (“POPI”).

• “Registered user(s)”refers to anyone registered on our Platforms and has provided us with a unique username and password as well as other Personal Information in order-to-order goods on our Platforms.

By agreeing to the Terms of service of the Grow Learning Platforms, you confirm that you are 18 (eighteen) years of age or older and of full legal capacity. If you are under the age of 18 (eighteen) or if you are not legally permitted to enter into a binding agreement, then you may use the Website only with the involvement and supervision of your parent or legal guardian.
 
WHY DO WE PROCESS YOUR PERSONAL INFORMATION?

Grow Learning processes the Personal Information we collect and receive from you,
·         To Identify and verify who you are.
We can communicate with you, and get feedback, regarding our products or services. This can extend to our promotions, competitions, new launches, billing, customer support, resolving complaints and/or quality control.
·       For Contractual obligations
In creating a user account, Grow Learning will enter a contract with you for you to purchase our goods, and for us to deliver those goods and process returns. This will comply with any legal or regulatory obligations such as tax or financial laws.

 WHAT PERSONAL INFORMATION DO WE COLLECT?

Grow Learning processes Personal Information in a manner that is reasonable, relevant and purpose specific. For users to access and use our Platforms we collect and process some Personal Information. When you become a registered user, we must collect and process your Personal Information to render our services to you.
When you register to use our Platforms, we may collect the following Personal Information:

• Name and Surname, Date of Birth, Identification number.
• Email address, Physical address, Billing information and Cell phone number.

Should your Personal Information change or you wish to amend and/or correct this Personal Information you can do this by updating your registered user information in your account profile.
You warrant that the information you have provided is accurate, current, true, and correct and that does not impersonate or misrepresent any person or entity or falsely state or otherwise misrepresent your affiliation with anyone or anything.

WHO HAS ACCESS TO MY PERSONAL INFORMATION?

Please note Grow Learning does not sell your personal information to third parties for marketing or any other purposes. The below are the only areas in which your Personal Information can be used.

• Internal Staff – Employees, the staff of the companies in the Grow Learning Group and/or third-party service providers or partners that assist us to interact with you via our Platforms for the marketing, ordering and/or delivery of goods.
• In the event of any reorganisation, merger, consolation, sale, joint venture, or other disposition of any or all our assets; third party(s) could be given access to your Personal Information.
• Any Officials - Law enforcement, government officials, fraud detection agencies or other third parties when the disclosure of Personal Information is necessary or appropriate in connection with an investigation of fraud, intellectual property infringements, or other activity that is illegal or may expose us to legal liability or financial loss, to report or support the investigation into suspected illegal activity.
• Exiting Service Providers - Our service providers who are at the time under contract with Grow Learning. These service providers can assist with various parts of the Grow Learning business. All contractors sign an NDA and may only use your Personal Information in connection with the services they perform for Grow Learning, and not for their own benefit or any other purpose. All information is treated as confidential.
• Service Providers outside of South Africa – Data storage, Data Integrity and back-up of information is critical to the security of our business. We may use service providers that can assist with data outside of South Africa. We will ensure that we do so in accordance with the requirements for lawful transfer outside of South Africa as set out in POPI.

 
HOW LONG DO YOU KEEP MY INFORMATION?

At Grow Learning we keep your Personal Information for,
·     The time it is required by law and in line with our internal retention policies, 
·     The time you have agreed to keep the contract open unless you have otherwise requested to stop processing your Personal Information.
By accessing and using our Platforms, you consent to Grow Learning retaining records of your Personal Information for no longer than may be necessary to achieve the purpose for which the information was initially collected or subsequently processed.
We will not use your Personal Information for any other purpose without your permission.
 
CAN I “OPT-OUT” FROM ANY DIRECT MARKETING?

You do have the right to request that you “opt – out”, of any direct marketing. Direct marketing is deemed to be any form of electronic communication such as email and/or SMS notifications.

By accessing and using the Grow Learning Platforms, you consent to our use of cookies.
What are Cookies? These are small text files placed on the device that you use to access our Platforms. These files do not contain your Personal Information but allow us to associate you with a particular device.

• Cookies make the Grow Learning Platforms more user friendly.
• They can personalise your user experience and interaction with us, as well as provide insights and tracking into your activity on the Platforms.

IS MY INFORMATION SECURE?

We all know that no method of transmission over the Internet, and method of electronic storage, can be 100% secure. Shopify is our preferred partner for our ecommerce store. They ensure the security and integrity of our platform. With independent auditors that asses the security of the data stored, as well as the financial systems.

 To protect your personal information, we take reasonable precautions and follow industry best practices to make sure it is not inappropriately lost, misused, accessed, disclosed, altered. Should you disclose your Personal Information to any third party other than Grow Baby or the Grow Learning Group, we shall not be liable for any loss or damage arising or suffered by you because of the disclosure of such Personal Information. You should always ensure that you read the privacy policy of any third party.

WHAT ARE YOUR RIGHTS?

As a registered user, you have the right to:

• View, correct and /or amend your Personal Information that we process.
• Request Grow Baby to correct, destroy or delete your Personal Information.
• Request a record of your Personal Information that we hold.
• Request that we notify you of unauthorised access to your Personal Information.
